Affiliate Program Terms and Conditions for Braaibrille.co.za

1. Introduction

Welcome to the Braaibrille.co.za Affiliate Program ("Program"). This document outlines the terms and conditions ("Terms") that govern your participation in the Program. By signing up as an affiliate ("Affiliate"), you agree to comply with these Terms.

2. Definitions

  • Affiliate: An individual or entity approved to participate in the Program.

  • Program: The affiliate marketing program operated by Braaibrille.co.za.

  • Commission: The earnings Affiliates receive for promoting and selling Braaibrille products.

  • Affiliate Link: A unique tracking link provided to Affiliates to promote Braaibrille products.

  • Qualified Sale: A successful purchase made through an Affiliate Link that meets the requirements set out in these Terms.

  • Cookie Duration: The 90-day period during which an Affiliate is credited for a sale.

3. Enrollment Process

  • Application: Affiliates must complete the online application form accurately and in full.

  • Approval: Braaibrille.co.za reserves the right to accept or reject any application at its discretion. Reasons for rejection may include but are not limited to inappropriate content on an applicant’s platform or a lack of alignment with our brand values.

4. Affiliate Responsibilities

  • Promotion: Affiliates may promote Braaibrille products using their Affiliate Link on websites, blogs, and social media.

  • Prohibited Conduct: Affiliates are prohibited from:

    • Engaging in deceptive advertising practices.

    • Using the "Braaibrille" trademark without written consent.

  • Sales Targets: Affiliates must generate at least R1,000 in sales per month to maintain their participation in the Program.

  • Compliance: Affiliates must adhere to all applicable South African laws and regulations.

5. Affiliate Links

  • Usage: Affiliates will be provided with unique tracking links to promote Braaibrille products.

  • Cookie Duration: Affiliates will receive credit for sales made through their link within 90 days of the initial click.

  • Tracking and Reporting: Braaibrille.co.za uses reliable tracking software to monitor Affiliate sales.

6. Commissions

  • Earning Criteria: Affiliates earn a 20% commission by i.) purchasing products at a 20% affiliate discount for resale at normal retail price, or ii.) by reffering retail customers that purchase products that exceed the minimum threshold of R1,000 per transaction.

  • Payment Schedule: Commissions earned are paid quarterly via bank transfer once the Affiliate has reached the minimum threshold of R1,000.

  • Currency and Fees: All payments are made in South African Rand (ZAR). Bank transfer fees, if any, will be deducted from the Affiliate’s earnings.

7. Restrictions and Prohibited Conduct

  • Trademark Use: Affiliates must not misuse or alter the Braaibrille trademark without prior approval.

  • Sales Fraud: Any fraudulent activities, such as manipulating sales or cookie stuffing, will result in immediate termination.

8. Term and Termination

  • Duration: This agreement remains in effect unless terminated by either party.

  • Termination Conditions: Braaibrille.co.za reserves the right to terminate an Affiliate’s participation if:

    • They fail to meet the monthly sales target of R1,000.

    • They engage in fraudulent or deceptive practices.

    • They masquerade as Braaibrille.co.za or its representatives.

  • Post-Termination Obligations: Affiliates must discontinue the use of Affiliate Links and trademarks immediately upon termination.

9. Confidentiality

Affiliates must maintain the confidentiality of any proprietary information provided during their participation in the Program.

10. Intellectual Property

Braaibrille.co.za retains all rights to its intellectual property, including but not limited to trademarks, logos, and promotional materials.

11. Indemnification

Affiliates agree to indemnify and hold harmless Braaibrille.co.za from any claims, damages, or liabilities arising from their participation in the Program.

12. Limitation of Liability

Braaibrille.co.za is not liable for any indirect, incidental, or consequential damages arising from the Program.

13. Disclaimer of Warranties

The Program is provided "as is," and Braaibrille.co.za disclaims all warranties, express or implied, including those of merchantability and fitness for a particular purpose.

14. Modification of Terms

Braaibrille.co.za reserves the right to modify these Terms at any time. Affiliates will be notified of significant changes via email or through the Affiliate portal.

15. Governing Law

These Terms are governed by the laws of the Republic of South Africa.

16. Dispute Resolution

Disputes will be resolved by a special meeting constituted of five members, with each party nominating two members and an impartial member nominated and voted for by both parties.

17. Miscellaneous

  • Independent Contractors: Affiliates are independent contractors and not employees of Braaibrille.co.za.

  • Non-Transferability: Affiliate accounts and benefits are non-transferable.

  • Entire Agreement: These Terms constitute the entire agreement between the parties.
